What Does "Marquee Compliance" Mean in Australia?

When councils, event organisers, schools and insurance companies ask for a "compliant" marquee, they're asking for documented proof across three areas:

1. Structural Engineering Certification

A structurally certified marquee has been independently assessed by a qualified structural engineer to confirm the frame can withstand the forces it will encounter during use - including wind loads, dead loads (the weight of the canopy and accessories) and live loads (such as rainwater pooling on the roof).

The engineer issues a formal Certificate of Compliance confirming the design meets the relevant Australian Standards, including AS/NZS 1170.0 (Structural Design Actions - General Principles) and AS/NZS 1170.2 (Wind Actions).

At Extreme Marquees, every frame in our entire folding marquee range carries independent engineer certification. This includes:

  • X5 True Blue - individual certificates for 3x3m, 3x4.5m and 3x6m sizes
  • X6 Velocity - certified across all sizes from 1.5x1.5m to 3x6m

2. Fire Testing Certification

Both of our canopy fabric types have been independently fire tested to confirm they meet Australian standards for flame retardancy: PVC coated polyester - Fire Test Certificate available 100% PVC fabric - Fire Test Certificate available Fire testing confirms that the fabric will not readily ignite, will self-extinguish rather than sustaining combustion, and meets the requirements for use at public events, near food service areas, and in commercial settings. This is commonly required by event organisers, councils and venue managers across all Australian states.

3. UV Protection Rating

Our canopy fabrics have been independently UV tested and achieve a UPF50+ rating - the highest possible rating for UV protection. This means our canopies block 98%+ of harmful UV radiation, providing maximum sun protection for people underneath.

UV testing is conducted against Australian standards by accredited laboratories. Our UV Test Certificates are available for both polyester and PVC fabrics from our Resource Centre.

This UPF50+ rating is particularly important for schools, sporting clubs and community organisations applying for SunSmart shade grants - grant programs typically require documented proof that shade structures meet minimum UV protection standards.

4. Wind Rating

Every Extreme Marquees frame has been assessed for wind resistance by qualified structural engineers. Our engineering certificates specify the maximum wind speed each frame can safely withstand when properly anchored, calculated against AS/NZS 1170.2 (Wind Actions).

All wind ratings assume correct anchoring using appropriate weights, pegs or tie-downs as specified in the HRIA Marquee Weighting Guide and our product documentation.

State-by-State Compliance Requirements

Marquee safety in Australia is governed by a combination of the National Construction Code (NCC), the ABCB Standard for Temporary Structures, and state-specific building regulations. The core engineering and safety standards are national, but each state has its own framework for permits, approvals and enforcement. Here is what you need to know for your state.

Victoria (VIC) - Prescribed Temporary Structures & Section 238

Victoria has the most prescriptive framework in Australia for temporary structures at events.

Key regulations:

  • Building Regulations 2018, Regulation 207 defines "prescribed temporary structures" as tents, marquees or booths with a floor area greater than 100 square metres. These require an Occupancy Permit from the Victorian Building Authority (VBA) before they can be erected at a public event.
  • Regulation 212 requires that the structural design of prescribed temporary structures be certified by a registered building practitioner.
  • The VBA requires an R126 Certificate of Compliance for the structural design, confirming the structure meets all relevant safety provisions of the Building Act 1993, Building Regulations 2018 and the National Construction Code.
  • The ABCB Standard for Temporary Structures 2015 is adopted by the VBA to determine compliance.
  • Occupancy permits can now be issued for state-wide use for up to 5 years (previously 3 years).

Even for marquees under 100 square metres, many Victorian councils, event organisers and venue managers require proof of structural engineering certification before approving a marquee on site. This is standard practice for school events, sporting club fixtures, council-run markets, festivals and any commercial event with public liability insurance requirements.

Victorian Shade Grants: The Victorian Government runs the Community Shade Grants Program and School Shade Grants Program through SunSmart and VicHealth. These grants fund up to 100% of the cost of portable shade structures for schools, sports clubs, community groups and councils. Queensland ( QLD) - Form 15, Building Act 1975 & SunSmart Shade Grants

Queensland regulates temporary structures through the Building Act 1975 and the Building Regulation 2021, administered by the Queensland Building and Construction Commission (QBCC).

Key requirements:

  • Temporary structures at public events (including marquees, stages and tents) may require a Development Permit for Building Work (building approval) depending on size and use. A licensed building certifier assesses compliance.
  • Form 15 - Compliance Certificate for Building Design or Specification is the Queensland equivalent of Victoria's R126. A competent person (typically a structural engineer) completes Form 15 to certify that a structural design complies with the Building Code of Australia (BCA) and relevant Australian Standards. The building certifier relies on this form when issuing building approval.
  • Form 12-Aspect Inspection Certificate (formerly part of Form 16) confirms that completed work has been installed to the design specification.
  • Councils across Queensland (including Brisbane, Gold Coast, Cairns, Townsville and regional areas) commonly request engineer certification and fire safety documentation for marquees at temporary entertainment events.
  • Queensland's framework requires building certifiers to determine whether temporary structures require a development permit. Even where permits are not required, compliance with the Building Code of Australia, Australian Standards and manufacturer's requirements is mandatory.

Queensland SunSmart Shade Creation Initiative: Run by Cancer Council Queensland and the Queensland Department of Health, this program provides up to 75-80% funding (maximum $2,000 for portable shade structures like marquees, up to $20,000-$30,000 for permanent shade) for not-for-profit organisations catering to children aged 0-18 years. Eligible organisations include schools, OSHC services, early childhood centres, junior sports clubs and youth community groups. Our UPFS0+ rated marquees qualify as portable shade under this program. New South Wales (NSW) - Construction Certificates & Council Event Approvals

New South Wales regulates building work (including temporary structures) through the Environmental Planning and Assessment Act 1979 and the Building and Development Certifiers Act 2018.

Key requirements:

  • Temporary structures at public events fall under individual council event permit requirements. Most NSW councils require proof of structural engineering certification and fire testing for marquees at public events.
  • For larger or permanent temporary structures, a Construction Certificate (CC) may be required. This is issued by an accredited certifier ( either council or private) and confirms that construction plans comply with the Building Code of Australia (BCA) and relevant Australian Standards.
  • The City of Sydney and other major councils are responsible for approving temporary structures such as marquees at events, and require engineering documentation.
  • Compliance Certificates may also be required under conditions of development consent to certify that a particular aspect of a development complies with regulations.

South Australia ( SA) - Building Rules Consent & Shade Grants

South Australia regulates building work through the Planning, Development and Infrastructure Act 2016 (PDI Act) and the Planning, Development and Infrastructure (General) Regulations 2017.

Key requirements:

  • Where a temporary structure constitutes "building work," a Building Rules Consent is required as part of the Development Approval process. Assessment is made against the Building Code of Australia and the South Australian Housing Code.
  • Building Rules Consent can be issued by council or by a Private Certifier registered with the South Australian Government.
  • Councils across Adelaide and regional SA commonly require engineering certification for marquees at community events, school carnivals and commercial functions.

South Australia Shade Grant Initiative: Cancer Council SA and Preventive Health SA partner to deliver the Shade Grant Initiative, providing education and care sites with up to $50,000 in funding to construct or repair shade structures. Western Australia (WA)

Building regulations in WA require compliance with the National Construction Code for temporary structures. Councils and event organisers commonly request engineer certification, fire testing and wind rating documentation. Our full certification pack meets these requirements.

Tasmania (TAS), Northern Territory (NT) & Australian Capital Territory (ACT)

Each jurisdiction follows the NCC with local council requirements for event approvals. Engineer certification is standard practice for public events across all three. Our certificates are nationally recognised and accepted by councils and event organisers Australia-wide.

The HRIA Marquee Weighting Guide - Explained

The Hire and Rental Industry Association (BRIA) publishes the Marquee Weighting Guide - the industry-standard reference for how much ballast weight is required to safely anchor a marquee at a public event.

The guide provides tie-down values in kilograms per leg for different marquee sizes and configurations, calculated by qualified structural engineers. The values account for:

  • Wind speed - the design wind speed for the location and exposure
  • Wall configuration - whether the marquee is fully open, partially enclosed or fully enclosed (adding walls changes the wind load profile)
  • Surface type - whether the marquee can be pegged into the ground or requires freestanding ballast on hard surfaces

Important: An unanchored marquee is a safety hazard. Every Extreme Marquee must be secured at every leg, every time - regardless of conditions. If sustained winds exceed 50km/h, pack down. No marquee is designed to remain erected in severe wind.

SunSmart Shade Grants - How We Can Help

Are your marquees engineer certified?

Yes. Every frame in our folding marquee range - XS True Blue, X6 Velocity, X7 Tectonic, Q8 Quasar and CS Classic Summit - carries independent structural engineering certification. Our larger event structures (Pavilion, Pinnacle, Dome and Inflatable ranges) are also individually certified per size. All certificates are freely available for download from our Resource Centre.

Do I need a certified marquee for a public event?

In most cases, yes. Across Australia, councils, event organisers and venue managers routinely require proof of structural engineering certification for marquees used at public events. In Victoria, marquees over 100m2 are legally classified as "prescribed temporary structures" requiring a VBA Occupancy Permit. Even for smaller marquees, certification is commonly requested for school events, markets, festivals and any event requiring public liability insurance.

What is the HRIA Marquee Weighting Guide?

The HRIA Marquee Weighting Guide is the industry-standard reference published by the Hire and Rental Industry Association. It specifies how much ballast weight (in kilograms per leg) is required to safely anchor different sizes of marquees at public events, based on wind speed, wall configuration and surface type. We design all our anchoring accessories to meet these requirements.

Are your marquees fire rated?

What UV protection do your canopies provide?

Wind ratings vary by frame model and size. Our Wind Speed Table (available from the Resource Centre) provides the specific rating for each product. All ratings are calculated by qualified structural engineers against AS/NZS 1170.2 (Wind Actions) and assume correct anchoring as per the HRIA Weighting Guide.

Do you have compliance documentation I can give to my council?

What is the difference between your compliance and cheaper marquees from retail stores?

Retail marquees from hardware and camping stores are designed for occasional personal use and typically do not carry structural engineering certification, fire testing, UV testing or wind ratings. They cannot be used at public events where compliance documentation is required by councils, event organisers or insurance companies.
